The City shall comply with requirements of this Unified Development Code, except where a chapter, article, division, or section is specifically exempted for the City in accordance with this Subsection.
A. Upon referral by the Development Services Director, the City Manager shall determine whether a submitted City-led project is exempt under this section from provisions of development requirements. A City-led project shall be considered as any type of development project where the City has sole ownership interest in the property being developed, the City has authority and jurisdiction over the development of the property, and the development of the project is intended to benefit the public. Such provisions may include expressed regulations within the following Subsections of this Unified Development Code:

4. 2.09.06 Residential Adjacency
5. 2.09.11 Nonresidential Design

B. City Council approval of Project Consent Authorizations. This section provides a voluntary mechanism for determining applicable regulations and exemptions for city-led projects within the Unified Development Code.
1. A proposed Project Consent Authorization (PCA) for a City-led project shall be submitted to the Development Services Director. The request must identify:
a. Current regulations under the Unified Development Code for which compliance would be required;
b. Additional restrictions on or applicable to the nature and intensity of the proposed development, subject to the following:
i. If the development process impacts a City Master Plan, Comprehensive Plan Element, or any other regulation outside of the Unified Development Code, the affected element shall be identified, presented, and considered under its applicable process; and
c. Any modifications, exemptions, or waivers requested as a condition of the agreement, including changes to the proposed regulations.
2. The Development Services Director may refer a PCA to the City Manager for consideration. In making a determination for referral, the Development Services Director shall consider:
a. Recommendation from directorial staff of participating City departments or public service entities regarding the benefits of the proposed agreement.
b. Potential burdens that the required regulations may have on the project.
3. Upon review of a PCA, the City Manager shall provide a recommendation of a PCA to the City Council for consideration. The City Manager may make a determination on whether to take forward a staff initiated PCA for consideration by City Council.
4. The City Council may direct the City Manager to make a recommendation of a PCA for consideration of a City-led project.
5. In acting on a PCA, the City Council may approve, deny, or modify the authorization. A PCA may waive or modify site development regulations applicable to a City-led project as deemed appropriate by the City Council.
6. Public notification of PCA consideration by City Council shall adhere to processes outlined in Section
2.10.04 Hearings and Notification Requirements.
